New York state unemployment recipients may pursue full-time education without immediately losing their weekly payments.

The Department of Labor’s Program 599 authorizes this flexibility for eligible students. Approval exempts beneficiaries from the standard requirement to actively seek employment while in class. This protection applies only when the state agency grants specific permission for the coursework.

Eligible training must lead to a specific occupation and meet educational standards for that field. Programs must include at least 12 academic credits per semester or 12 hours of weekly instruction. The course of study must be completable within 24 months of approval. Applicants can also qualify for high school equivalency certificates if they meet the same time and hour requirements.

Beneficiaries who continue studying after regular benefits expire may receive up to 26 additional weeks of support under section 599.2. These additional payments are not automatic. They depend on individual eligibility and available state funds. The program does not cover tuition costs, and approval does not guarantee payments will last until the student finishes their degree.

Applicants should submit the Program 599 form within the first 13 weeks of their unemployment claim to maximize potential benefits. The Department of Labor recommends filing the request as soon as a school accepts the student. Those already enrolled must submit the form immediately. Filing while still collecting regular benefits is mandatory for consideration.

State law caps annual payments under section 599.2 at $20 million. A waiting list determines payment priority based on approval dates. Funds become available on July 1 each year. Individuals approved after the current funding cutoff, marked August 17, 2026, remain on the list until new money is allocated.

While waiting for funds, beneficiaries cannot certify for additional benefits. Once their case is evaluated, they must return a questionnaire with their academic transcript within 14 days. Payments begin only when funds are available, with no retroactive coverage for the waiting period. Students who finish their courses before funds arrive will not receive the additional weeks.

For questions or to request the form, callers can dial 518-402-0189. Individuals not yet enrolled can visit a New York State Career Center for guidance on training options. Further details are available on the official Program 599 website.
