Judge Alvin Hellerstein died on Tuesday of natural causes at the age of 92. The court confirmed the death occurred just days before his 93rd birthday. He was presiding over the federal case against former Venezuelan President Nicolás Maduro at the time of his passing.
Hellerstein joined the federal bench in 1998 after a nomination from President Bill Clinton. Before that appointment, he spent 38 years in private legal practice. He also served in the U.S. Army JAG Corps from 1957 to 1960. The Federal Judicial Center records that he earned both his bachelor's degree and his law degree from Columbia University.
His docket included several high-profile matters in the Southern District of New York. He handled President Donald Trump's legal efforts to transfer his New York criminal case from state to federal court. He also managed the litigation against Maduro, a dispute that has drawn national attention for years.
Maduro and his wife, Cilia Flores, face a charge of conspiracy to commit torture against Americans and others. A superseding indictment filed in early October outlines the allegations. The document states that Maduro's government used violence against political opposition and arbitrary detention. It lists specific methods including electric shock, asphyxiation, rape, and forced nudity.
Prosecutors argue the couple used physical and mental suffering to punish opponents and protect their power. The indictment mentions kidnappings and threats to harm families, including children. If the court finds that any of the alleged torture resulted in death, the maximum sentence for the conspiracy charge is life in prison. If no death resulted, the maximum is 20 years.
The defendants face numerous other charges. Maduro was first charged in a 2011 indictment that the Trump Justice Department unsealed in 2020. Those counts include narco-terrorism conspiracy and cocaine importation conspiracy. Flores was added to the case in a January superseding indictment. Both were arrested in Venezuela in January during Operation Absolute Resolve.
Both defendants have pleaded not guilty. A trial is currently scheduled for June 2027. With Hellerstein's death, a new judge is expected to be randomly assigned to the matter. This reassignment will occur before the next scheduled proceedings in the case.
